Smart Apply Authorization Agreement

Authorization terms for our AI-assisted job application feature.

1. Purpose and Overview

This Smart Apply Authorization Agreement ("Authorization") governs your use of the Smart Apply feature offered by TheSHFTApp LLC ("TheSHFTApp," "we," "us," or "our"). Smart Apply uses AI Systems to assist you in preparing, populating, and submitting job applications on your behalf to employers, job boards, ATS platforms, and other hiring systems.

Before activating Smart Apply, you must review and accept this Authorization. Your activation of Smart Apply constitutes your agreement to the terms set forth herein.

This Authorization supplements and is subject to the Terms of Use, Acceptable Use Policy, and Privacy Policy. Capitalized terms have the meanings set forth in the Master Definitions.


2. What Smart Apply Does

Smart Apply may perform any or all of the following actions, depending on your settings and the target application platform:

  • Auto-populate job application fields using your Resume Data, Career Intelligence Profile, Answer Vault entries, and Professional Information;
  • Generate or adapt cover letters, personal statements, and application essays using AI Systems;
  • Generate answers to employer-specific application questions using AI Systems and your Answer Vault;
  • Reformat or optimize your Resume for specific job descriptions;
  • Submit completed applications to designated job boards, ATS systems, or employer portals; and
  • Store records of applications submitted through Smart Apply in your Application Tracker.

3. Your Authorization

By activating Smart Apply for a specific application or job search session, you expressly authorize TheSHFTApp to:

  • Access your Resume Data, Career Intelligence Profile, Answer Vault, and Professional Information to populate application materials;
  • Use AI Systems to generate, adapt, or reformat application content on your behalf;
  • Transmit your application materials and Personal Information to the applicable employer, ATS system, job board, or third-party hiring platform; and
  • Store records of submitted applications and associated materials in your Account for your review and records.

4. Your Mandatory Review Obligation

4.1 Review Before Submission. BEFORE AUTHORIZING SMART APPLY TO SUBMIT ANY APPLICATION, YOU MUST REVIEW AND APPROVE THE COMPLETE APPLICATION MATERIALS, INCLUDING ALL AI-GENERATED OR AI-ASSISTED CONTENT.

4.2 Your Responsibility. By proceeding with a Smart Apply submission, you confirm that you have reviewed the materials and that:

  • All information is accurate and truthful;
  • All credentials, qualifications, and experience represented are genuine;
  • The application materials appropriately represent you;
  • You are legally authorized to work in the jurisdiction where the position is located; and
  • The submission does not violate any applicable employer, job board, or platform terms.

4.3 AI Content Accuracy. TheSHFTApp does not guarantee the accuracy of AI-generated application content. You are solely responsible for catching and correcting errors, hallucinations, or inaccuracies in AI Output before submission.


5. Third-Party Platform Compliance

5.1 Your Obligation. You are solely responsible for ensuring that your use of Smart Apply complies with the terms of service, acceptable use policies, and technical requirements of any third-party job board, employer website, ATS system, or hiring platform to which applications are submitted.

5.2 No Guarantee of Compatibility. TheSHFTApp does not guarantee that Smart Apply is compatible with, permitted by, or approved by any specific third-party platform. Restrictions imposed by third-party platforms are your responsibility to identify and comply with.

5.3 No Circumvention of Employer Rules. You may not use Smart Apply to circumvent employer anti-bot measures, application quantity limits, submission rules, or other platform protections.


6. No Employment Guarantee

Smart Apply is an application preparation and submission tool. TheSHFTApp does not guarantee that any application submitted through Smart Apply will be:

  • Received or processed by the employer;
  • Reviewed by a human recruiter or hiring manager;
  • Considered for the position;
  • Competitive or successful; or
  • Compliant with ATS requirements of any specific employer.

All hiring decisions are made solely by the applicable employer. TheSHFTApp has no influence over employer hiring decisions.


7. Data Handling

Application materials prepared and submitted through Smart Apply are processed as described in the Privacy Policy (Section 9 โ€” Smart Apply Data Handling). This includes storage of AI Inputs, AI Outputs, application materials, and submission records in your Account. Third-party employers and platforms that receive your application materials control the data they receive in accordance with their own privacy policies.


8. Revocation and Cancellation

8.1 Per-Session Authorization. Each Smart Apply submission requires your affirmative action. Authorizing one submission does not constitute blanket authorization for future submissions.

8.2 Disabling Smart Apply. You may disable Smart Apply in your Account settings at any time. Disabling Smart Apply prospectively prevents future auto-submissions but does not retract applications already submitted.

8.3 Retracting Applications. TheSHFTApp cannot retract or delete applications once transmitted to third-party platforms. Contact the applicable employer or job board directly to request withdrawal of a submitted application.


9. Liability

TheSHFTApp's liability for Smart Apply is subject to the limitations set forth in Section 18 of the Terms of Use. TheSHFTApp is not liable for:

  • Errors in AI-generated content that you approved for submission;
  • Consequences resulting from applications submitted to employers based on inaccurate user-provided data;
  • Third-party platform rejections, errors, or non-delivery of submitted applications; or
  • Employer decisions or outcomes resulting from any application.
