DMCA Policy

Copyright infringement notice and counter-notice procedures.

1. Introduction

TheSHFTApp LLC ("TheSHFTApp") respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. ยง 512, TheSHFTApp has implemented procedures for addressing claims of copyright infringement.


2. Designated DMCA Agent

TheSHFTApp has designated the following agent to receive notifications of claimed copyright infringement:

3. Filing a DMCA Takedown Notice

If you believe that content available on the Platform infringes your copyright, you may submit a written notice to our DMCA Agent containing the following information required by 17 U.S.C. ยง 512(c)(3):

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are at issue.
  1. Identification of the infringing material: A description of the material you claim is infringing and its location on the Platform (including URL or specific description sufficient to enable TheSHFTApp to locate the material).
  1. Your contact information: Your name, address, telephone number, and email address.
  1. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  1. Accuracy statement: A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  1. Signature: Your physical or electronic signature.

Notices that do not comply with these requirements may not be processed.


4. Counter-Notice Procedures

If you believe content you posted was removed due to a mistaken or misidentified DMCA takedown, you may submit a counter-notice to our DMCA Agent containing:

  1. Identification of the removed material and its location before removal;
  2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  3. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for your district (or if located outside the U.S., any judicial district in which TheSHFTApp may be found), and that you will accept service of process from the original complainant;
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notice, TheSHFTApp may restore the removed content within 10โ€“14 business days unless the original complainant provides notice of a court action.


5. Repeat Infringer Policy

TheSHFTApp maintains a policy of terminating, in appropriate circumstances, Accounts of users who are determined to be repeat infringers.


6. Misuse of DMCA Process

Filing a false DMCA claim is a serious matter with legal consequences under 17 U.S.C. ยง 512(f). If you are not certain whether content infringes your copyright, consult an attorney before filing.
