Acceptable Use Policy

Permitted and prohibited conduct on the TheSHFTApp platform.

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs the conduct of all Users of the TheSHFTApp Platform and Services, including job seekers, Workers, SHFTRs, Candidates, Employers, Recruiters, Enterprise Customers, developers, and all other registered or unregistered visitors.

This AUP is incorporated into and forms part of the Terms of Use. Capitalized terms have the meanings set forth in the Master Definitions or the Terms of Use. Violation of this AUP may result in suspension or termination of your Account and access to the Services.


2. General Standards

You agree to use the Platform and Services only:

  • For lawful purposes;
  • In accordance with these Terms of Use and this AUP;
  • In a manner that respects the rights and dignity of other users;
  • Consistent with the intended career, workforce, recruiting, and business purposes of the Platform; and
  • In compliance with all applicable local, state, federal, and international laws and regulations.

3. Prohibited Conduct

3.1 Identity and Credential Fraud

You may not:

  • Impersonate any person, company, employer, recruiter, or entity;
  • Misrepresent your identity, credentials, qualifications, certifications, education, work experience, or professional affiliations;
  • Create a false profile, fake Account, or use another person's identity without their express authorization;
  • Submit fabricated references, forged documents, or false employment verification;
  • Present a fraudulent resume or falsified career history; or
  • Misrepresent your relationship to a business entity.

3.2 AI and Automation Abuse

You may not:

  • Use AI Systems available through the Platform for purposes unrelated to career development, workforce activities, job searching, recruiting, or authorized platform activities;
  • Attempt to jailbreak, override, manipulate, or circumvent AI safety controls, content filters, or system prompts;
  • Use automated bots, scripts, scrapers, or data extraction tools to access or harvest content from the Platform, except through expressly authorized API access;
  • Generate AI Outputs intended to deceive, defraud, or mislead employers, recruiters, or third parties;
  • Systematically generate AI content for resale or redistribution outside the Platform;
  • Use AI features to create spam, mass-generated low-quality applications, or artificially inflate engagement metrics; or
  • Extract, replicate, reverse engineer, or steal TheSHFTApp's AI prompts, system prompts, workflows, model configurations, or proprietary AI processes.

3.3 Data Scraping and Intellectual Property Violations

You may not:

  • Scrape, crawl, spider, or systematically extract data from the Platform by any means not authorized by TheSHFTApp;
  • Copy, reproduce, distribute, or create derivative works from Platform content without authorization;
  • Harvest contact information, job listings, candidate profiles, or employer data for use outside the Platform;
  • Attempt to extract training data, model weights, embeddings, or proprietary datasets;
  • Build a competing product or service using data obtained from the Platform; or
  • Violate any applicable copyright, trademark, trade secret, or patent rights.

3.4 System Integrity and Security

You may not:

  • Probe, scan, or test the vulnerability of the Platform or any related infrastructure without written authorization from TheSHFTApp's security team;
  • Attempt to gain unauthorized access to any account, system, or network;
  • Upload or transmit malware, viruses, ransomware, or other malicious code;
  • Conduct denial-of-service attacks or otherwise disrupt the Platform's availability;
  • Circumvent or attempt to circumvent authentication, access controls, or security measures;
  • Intercept or monitor data transmissions without authorization; or
  • Use the Platform in any manner that disproportionately burdens infrastructure.

3.5 Third-Party Platform Violations

You may not:

  • Use Smart Apply, browser extensions, or other Platform features in a manner that violates the terms of service, acceptable use policies, or technical restrictions of any third-party job board, employer website, ATS system, or professional platform;
  • Circumvent applicant tracking requirements, employer submission processes, or job board anti-bot measures;
  • Submit applications to platforms or employers that prohibit AI-assisted applications where you have been notified of such restrictions; or
  • Use the Services to facilitate violations of third-party network rules or terms.

3.6 Fraud, Deception, and Misrepresentation

You may not:

  • Engage in phishing, social engineering, or deceptive communications;
  • Post false, misleading, or deceptive job listings or employer information;
  • Fraudulently obtain access to Premium Services, AI Credits, or features without valid payment;
  • Circumvent subscription, credit, or billing systems through technical or social means;
  • Misrepresent the source, nature, or origin of content submitted to the Platform; or
  • Engage in any fraudulent use of referral, affiliate, or incentive programs.

3.7 Harassment, Abuse, and Prohibited Content

You may not:

  • Harass, threaten, bully, intimidate, or abuse any other user or TheSHFTApp personnel;
  • Post or transmit content that is defamatory, hateful, discriminatory, or promotes violence;
  • Transmit sexually explicit or exploitative content;
  • Stalk, doxx, or otherwise expose private information about other individuals;
  • Use the Platform to facilitate human trafficking, forced labor, or exploitation; or
  • Violate any anti-discrimination laws in connection with the Platform.

3.8 Employer and Recruiter Restrictions

Employers and Recruiters additionally may not:

  • Post fraudulent, misleading, or bait-and-switch job listings;
  • Contact candidates for purposes unrelated to legitimate employment or engagement;
  • Use candidate data obtained through the Platform for purposes outside the scope of their agreement with TheSHFTApp;
  • Discriminate against candidates on the basis of any protected characteristic; or
  • Engage in wage theft, fee-charging to workers, or practices that violate applicable labor law.

4. Reporting Violations

5. Enforcement

TheSHFTApp reserves the right to:

  • Investigate suspected violations of this AUP;
  • Remove content that violates this AUP;
  • Suspend or terminate Accounts involved in violations;
  • Report violations to law enforcement or regulatory authorities where appropriate;
  • Seek injunctive or other legal relief for ongoing violations; and
  • Recover damages for harm caused by AUP violations.

TheSHFTApp exercises enforcement discretion and is not obligated to take action in every instance.


6. Modifications

This AUP may be updated from time to time. Continued use of the Services after an update constitutes acceptance of the revised AUP.
