Recruiter Platform Terms

Supplemental terms for recruiter accounts and the Recruiter Platform.

1. Introduction

These Recruiter Platform Terms ("Recruiter Terms") govern access to and use of the TheSHFTApp Recruiter Platform by recruiters, talent acquisition professionals, staffing agencies, and other recruiting professionals ("Recruiter," "you," or "your").

These Terms supplement the Terms of Use and Employer Platform Terms (where applicable). Capitalized terms have the meanings in the Master Definitions.


2. Recruiter Eligibility

2.1 Professional Use. The Recruiter Platform is intended for recruiting professionals who source, evaluate, place, or refer candidates as part of a legitimate business or professional practice.

2.2 Verification. TheSHFTApp may require verification of your recruiter credentials, agency affiliation, or business identity before granting full Recruiter Platform access.

2.3 Compliance with Laws. You represent that you are licensed (where legally required), operate a legitimate recruiting practice, and will comply with applicable labor, employment, and anti-discrimination laws.


3. Permitted Recruiter Activities

You may use the Recruiter Platform to:

  • Search and identify candidates who have opted into recruiter contact;
  • Access candidate profiles, Career Intelligence Profiles, and resumes shared by consenting candidates;
  • Use AI candidate matching and sourcing tools;
  • Manage candidate pipelines and communications;
  • Create and manage job listings (if you have posting rights);
  • Refer or present candidates to Employer clients; and
  • Use analytics and reporting tools within your plan.

4. Candidate Data Obligations

4.1 Consent-Based Access. You may only access candidate data for candidates who have enabled recruiter visibility or who have matched with you through the Platform's consent-based mechanisms.

4.2 Permitted Use. You may use candidate data only to evaluate and present candidates for legitimate employment or engagement opportunities. Data may not be repurposed for marketing, data brokering, database building for competitive purposes, or any purpose outside legitimate recruiting.

4.3 Data Handling. You must handle candidate data in compliance with applicable privacy laws. If you operate as a data processor on behalf of an employer client, you are responsible for maintaining appropriate data handling agreements with your clients.

4.4 Non-Circumvention. You may not use the Platform to identify and then circumvent TheSHFTApp by contacting candidates outside the Platform for competitive or fee-avoidance purposes.


5. Compensation and Fees

5.1 Platform Fees. Access to Recruiter Platform features may require a subscription or per-use fees as described in the Subscription and AI Credits Terms or your applicable order form.

5.2 Placement Compensation. TheSHFTApp may earn referral, placement, or success fees in connection with candidates referred or matched through the Platform. This does not create a co-agency or joint-venture relationship between TheSHFTApp and you.

5.3 No Charging Candidates. You may not charge candidates a fee for recruitment services through the Platform unless expressly permitted under applicable law and disclosed to the candidate.


6. Representations and Compliance

You represent and warrant that:

  • All job opportunities you present to candidates are legitimate;
  • You have the legal authority to present candidates to the employers or clients you represent;
  • You will not discriminate against candidates based on any protected characteristic;
  • You will comply with applicable labor, employment, and privacy laws; and
  • You will honor confidentiality obligations with respect to both candidate and employer information.

7. Recruiter Code of Conduct

All Recruiters must comply with the Recruiter Code of Conduct, which is incorporated herein.


8. Termination

TheSHFTApp may suspend or terminate your Recruiter Account for violation of these Terms, the Terms of Use, the Recruiter Code of Conduct, or applicable law.
