1. Purpose
This Recruiter Referral Consent ("Consent") governs TheSHFTApp LLC's ("TheSHFTApp," "we," "us," or "our") presentation, referral, submission, or recommendation of your candidacy to Recruiters, Employers, staffing partners, hiring platforms, and job boards ("Referral Recipients").
By activating Recruiter Referral features or agreeing to this Consent, you authorize TheSHFTApp to engage in the referral activities described herein on your behalf.
This Consent is part of and subject to the Terms of Use and Privacy Policy.
2. What You Are Authorizing
By providing your consent, you expressly authorize TheSHFTApp to:
(a) Present Your Profile. Share your Career Intelligence Profile, Resume Data, Professional Information, and relevant Applicant Data with Referral Recipients who may have relevant employment or engagement opportunities for you.
(b) Submit Your Candidacy. Present, recommend, or refer you as a candidate to Referral Recipients for open positions, talent pools, or future consideration.
(c) Facilitate Communication. Facilitate introductions, pass along messages, and coordinate between you and Referral Recipients.
(d) Share Application Materials. Transmit resumes, cover letters, application answers, and related materials you have associated with your referral profile to Referral Recipients.
(e) Match to Opportunities. Use AI Systems to identify and match you to potential opportunities and present you to Referral Recipients based on those matches.
3. Information That May Be Shared
The following information may be shared with Referral Recipients pursuant to this Consent:
- Name and contact information
- Career Intelligence Profile
- Resume and Resume Data
- Work history, education, and credentials
- Skills and competencies
- Job preferences, location, and availability
- Salary expectations (if provided)
- Application answers and supporting materials
- AI-generated career profile summaries
We will not share sensitive personal data (such as health information or government ID numbers) with Referral Recipients without separate express consent.
4. Compensation Disclosure
TheSHFTApp may receive compensation from Referral Recipients in connection with successful referrals, placements, hires, or engagement of candidates referred through the Platform. This compensation may include:
- Placement fees or finders fees
- Referral fees or success fees
- Recruiter commissions
- Staffing fees
- Employer subscription or job posting fees
- Per-placement fees
The receipt of such compensation by TheSHFTApp does not create a fiduciary or agency relationship between TheSHFTApp and you, does not obligate TheSHFTApp to secure employment for you, and does not affect the terms or conditions of any employment or engagement you may enter into with a Referral Recipient.
5. No Guarantee of Employment
Providing this Consent and activating Recruiter Referral features does not guarantee:
- Any introductions or referrals will be made
- Any employer or recruiter will respond to or review your profile
- Any interview will be scheduled
- Any offer of employment will be extended
- Any specific outcome, placement, or result
All employment decisions are made exclusively by the applicable Referral Recipient.
6. Third-Party Privacy Practices
Once your information is shared with a Referral Recipient, that party's independent privacy practices apply to the data they receive. TheSHFTApp is not responsible for how Referral Recipients use, store, or process your information after receipt. We encourage you to review the privacy policies of any employer or recruiter before sharing your information.
7. Your Privacy Rights
Your information is processed as described in our Privacy Policy. TheSHFTApp does not sell your Personal Information. Your data shared through Recruiter Referrals is used solely for career-matching and employment facilitation purposes.
8. Revoking Consent
8.1 Revocation. You may revoke your Recruiter Referral Consent at any time by adjusting your referral settings in your Account or contacting support@theshftapp.com.
8.2 Effect of Revocation. Revocation is prospective. It does not undo referrals already made or retrieve data already shared with Referral Recipients. To request removal of your data from a Referral Recipient, contact that party directly.
8.3 Re-Activation. You may re-activate Recruiter Referral features at any time by re-accepting this Consent.
9. Scope and Duration
This Consent remains active until you revoke it or close your Account, subject to data retention obligations described in the Data Retention and Deletion Policy.
