1. Introduction
This Recruiter Code of Conduct ("Code") establishes the ethical and professional standards required of all Recruiters using the TheSHFTApp Platform. Recruiters include independent recruiters, agency recruiters, talent acquisition professionals, staffing specialists, and headhunters.
Compliance with this Code is a condition of continued Recruiter Platform access. This Code supplements the Recruiter Platform Terms and Terms of Use.
2. Professional Integrity
2.1 Recruiters must represent themselves, their agency or firm, and the opportunities they present accurately and honestly.
2.2 Recruiters must not misrepresent their credentials, relationships with employer clients, or the nature of any opportunity.
2.3 Recruiters must not present multiple candidates for the same role without transparency about the nature of the engagement.
2.4 Recruiters must honor confidentiality obligations with respect to candidate information and employer requirements.
3. Candidate Engagement
3.1 Recruiters must contact candidates only for legitimate recruitment purposes related to opportunities they are actively pursuing on behalf of identified clients.
3.2 Recruiters must not solicit candidates for purposes other than those disclosed at the time of outreach.
3.3 Recruiters must communicate with candidates professionally, honestly, and with reasonable promptness.
3.4 Recruiters must not make representations about compensation, role fit, or offer likelihood that they cannot reasonably support.
3.5 Recruiters must provide candidates with timely updates on the status of their candidacy to the extent within the recruiter's control.
3.6 Recruiters must not charge candidates for recruitment services except where expressly permitted by applicable law and disclosed to the candidate in advance.
4. Candidate Data
4.1 Recruiters may access candidate data only for consented, legitimate recruitment purposes.
4.2 Recruiters may not submit a candidate's information to an employer or client without first obtaining the candidate's consent.
4.3 Recruiters must handle candidate personal information in compliance with applicable privacy laws.
4.4 Recruiters may not share candidate data with third parties not directly involved in the candidate's recruitment process.
4.5 Recruiters may not use candidate data to build competing databases, platforms, or services.
5. Non-Discrimination
Recruiters must comply with all applicable employment discrimination laws and may not screen, filter, or recommend candidates based on protected characteristics.
6. Employer Relationships
6.1 Recruiters must represent employer client opportunities accurately to candidates.
6.2 Recruiters must not present candidates to employers without proper authorization.
6.3 Recruiters must comply with any applicable fee disclosure requirements under state or local law.
7. Non-Circumvention
Recruiters may not use the Platform to identify candidates and then directly contact them outside the Platform for the purpose of avoiding Platform fees or processes.
8. Enforcement
Violations of this Code may result in suspension or permanent termination of Recruiter Platform access and may be reported to relevant professional associations or authorities.
