1. Age Requirements
The TheSHFTApp Platform and Services are intended exclusively for individuals who are eighteen (18) years of age or older. TheSHFTApp LLC ("TheSHFTApp") does not knowingly collect, solicit, or maintain Personal Information from individuals under the age of 18.
By creating an Account or using the Services, you represent and warrant that you are at least 18 years old.
2. Children's Online Privacy Protection Act (COPPA)
TheSHFTApp does not direct its Services to children under the age of 13 and does not knowingly collect Personal Information from children under 13 without verifiable parental consent, as required by the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506.
If we learn that we have inadvertently collected Personal Information from a child under 13, we will:
- Delete that information promptly from our systems;
- Close any associated Account; and
- Notify the relevant parent or guardian if we have contact information.
3. Minors Between 13 and 17
Individuals between the ages of 13 and 17 are also not permitted to use the Services without verified parental or legal guardian consent. TheSHFTApp may offer limited, restricted functionality for users in this age range in the future through a supervised or parental-consent account model, but currently does not offer Services to minors.
4. Age Verification
During registration, users must affirm that they are at least 18 years of age. TheSHFTApp reserves the right to implement additional age verification measures where required by applicable law.
If we become aware that a user is under 18 and has not obtained required parental consent, we will suspend and delete the Account.
5. Parental Rights
If you believe your child under 18 has created an Account or provided Personal Information to TheSHFTApp without your consent, please contact us at privacy@theshftapp.com. We will:
- Verify your parental relationship;
- Provide information we have collected (if legally required);
- Delete the Account and associated Personal Information; and
- Cease further collection.
6. Family Educational Rights and Privacy Act (FERPA)
TheSHFTApp does not directly work with educational institutions or access student education records. To the extent any user may be a student, FERPA rights apply to educational institutions holding those records, not to TheSHFTApp.
