1. Purpose
This Policy describes how TheSHFTApp LLC ("TheSHFTApp," "we," "us," or "our") handles requests from law enforcement agencies, government bodies, regulatory authorities, and courts for User Data or other information.
2. Our Approach
TheSHFTApp takes user privacy seriously and evaluates each legal request individually. We:
- Review all requests for legal sufficiency before complying;
- Produce only the minimum data necessary to satisfy a valid legal request;
- Notify users of legal requests for their data where legally permitted to do so; and
- Do not voluntarily assist law enforcement beyond what is legally required.
3. Types of Legal Process We Recognize
3.1 Valid Legal Process. TheSHFTApp generally requires valid legal process before disclosing non-public User Data to law enforcement or government agencies, including:
- Court order (U.S. federal or state court of competent jurisdiction)
- Subpoena (with appropriate jurisdiction)
- Search warrant issued by a court upon probable cause
- Administrative subpoena or civil investigative demand (from agencies with authority)
- National security letter (NSL) where legally applicable
3.2 Emergency Requests. In emergency situations involving imminent risk of death or serious physical injury, we may disclose limited information as permitted by 18 U.S.C. ยง 2702(b)(8) or applicable law.
3.3 International Requests. International law enforcement requests must comply with applicable mutual legal assistance treaty (MLAT) requirements or other applicable legal frameworks. We do not comply with requests from foreign law enforcement that do not satisfy applicable U.S. law.
4. What We May Disclose
In response to valid legal process, we may disclose, as required:
- Account registration information (name, email, registration date)
- IP address and login history
- Device information
- Billing and payment records
- Communications metadata
- User Content as specifically compelled
We will assert available legal protections, privileges, and objections to overbroad or improper requests.
5. Notice to Users
We will notify the affected user before disclosing their data if we are not prohibited from doing so by law, by the terms of a gag order, or by exigent circumstances. If notice is temporarily prohibited, we will provide notice when legally permitted.
6. Transparency
We intend to publish periodic transparency reports summarizing the aggregate number and types of government data requests we receive, to the extent permitted by law.

- Identifying information for the requesting agency
- The specific legal process being invoked
- Identification of the specific user data being requested
- Certification of legal authority
Informal inquiries or requests not backed by valid legal process will not be honored.
