1. Overview
TheSHFTApp LLC ("TheSHFTApp") complies with applicable U.S. export control laws and regulations and economic sanctions programs administered by U.S. government agencies, including:
- The Export Administration Regulations (EAR), administered by the U.S. Department of Commerce Bureau of Industry and Security (BIS);
- Economic sanctions programs administered by the U.S. Department of the Treasury Office of Foreign Assets Control (OFAC); and
- The International Traffic in Arms Regulations (ITAR), administered by the U.S. Department of State Directorate of Defense Trade Controls (DDTC), to the extent applicable.
2. Prohibited Use
You may not use the Platform or Services if:
(a) You are located in, or a national or resident of, any country or territory subject to comprehensive U.S. sanctions, including without limitation Cuba, Iran, North Korea, Russia (for sanctioned activities), Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine, or any other country or territory that may become subject to comprehensive sanctions.
(b) You are a Specially Designated National (SDN) or otherwise listed on OFAC's SDN List, or are owned or controlled by a person on such list.
(c) You are listed on any U.S. government denied parties list, including the BIS Entity List, Unverified List, Denied Persons List, or State Department Debarred Parties List.
(d) You intend to use the Services for purposes prohibited under U.S. export law, including in connection with weapons of mass destruction, military end-uses in embargoed countries, or other prohibited end-uses.
3. User Representation
By using the Services, you represent and warrant that:
- You are not located in a comprehensively sanctioned country or territory;
- You are not a Specially Designated National or otherwise listed on applicable denied parties lists;
- You will not export, re-export, or transfer any Platform content, software, or technology in violation of applicable export control laws; and
- Your use of the Services does not violate any applicable export control or sanctions law.
4. Geographic Restrictions
TheSHFTApp reserves the right to restrict access to the Platform from certain geographic locations to comply with applicable law. Such restrictions may be implemented at any time without prior notice.
5. Technology Export
The Platform includes software and technology that may be subject to U.S. export control laws. By downloading or using Platform software (including mobile applications and Browser Extensions), you confirm compliance with this Policy.
6. Sanctions Screening
TheSHFTApp may conduct sanctions screening of users, Business Customers, and transactions as part of its compliance program.

8. Updates
Export control and sanctions laws change frequently. This Policy will be updated as needed to reflect applicable legal requirements.
