Employer Platform Terms

Supplemental terms for employer accounts and the Employer Platform.

1. Introduction

These Employer Platform Terms ("Employer Terms") govern the access to and use of TheSHFTApp's Employer Platform by employers and their authorized personnel ("Employer," "you," or "your"). The Employer Platform is a suite of tools within the TheSHFTApp Platform designed for organizations to source, evaluate, and engage candidates.

These Employer Terms supplement the Terms of Use, which remain fully applicable. In the event of a conflict between these Employer Terms and the Terms of Use, these Employer Terms control with respect to Employer Platform use.


2. Employer Account

2.1 Registration. To access the Employer Platform, you must register an Employer Account and provide accurate business information including company name, contact information, and billing details.

2.2 Authorized Users. You are responsible for managing authorized personnel with access to your Employer Account (your "Workspace"). You are responsible for all actions taken by authorized users under your Account.

2.3 Verification. TheSHFTApp may require verification of your business identity or legitimacy before activating full Employer Platform access.


3. Permitted Uses

Subject to these Terms, you may use the Employer Platform to:

  • Create and manage job postings;
  • Search, filter, and review Candidate profiles;
  • Access Career Intelligence Profiles shared by consenting Candidates;
  • Communicate with Candidates through Platform messaging tools;
  • Use AI-powered candidate matching and sourcing features;
  • Manage hiring workflows and application pipelines;
  • Access employer analytics and reporting dashboards; and
  • Configure team Workspaces for authorized recruiting team members.

4. Job Postings

4.1 Accuracy. All job postings must accurately represent the position, including title, job type, compensation, location, required qualifications, and employment terms.

4.2 Legitimate Openings. You may only post positions for which you have a genuine, existing, or imminent hiring need.

4.3 Prohibited Listings. You may not post:

  • Fraudulent, misleading, or deceptive listings;
  • "Ghost" job postings with no real opening;
  • Listings intended solely to collect candidate data;
  • Listings requiring candidates to pay fees to apply;
  • Multi-level marketing, pyramid scheme, or similar solicitations; or
  • Listings that violate applicable employment laws.

4.4 Employer Content License. You grant TheSHFTApp a license to display, promote, and distribute your job postings within the Platform and through distribution channels.


5. Candidate Data

5.1 Permitted Use. Candidate data made available to you through the Employer Platform (including Career Intelligence Profiles, Resumes, and application materials) may be used only for legitimate hiring and employment evaluation purposes within your organization.

5.2 Restrictions. You may not:

  • Share candidate data with third parties outside your organization without candidate consent;
  • Use candidate data for purposes unrelated to hiring (e.g., marketing, data brokering);
  • Retain candidate data beyond the period permitted by applicable law and your agreement with TheSHFTApp;
  • Use candidate data to build competing products or services; or
  • Combine candidate data with other datasets in a manner that would violate applicable privacy law.

5.3 Data Processing. If you are an enterprise-level Employer handling significant volumes of personal data, you may be required to enter into a Data Processing Addendum (DPA) with TheSHFTApp.


6. Non-Discrimination

You agree to comply with all applicable federal, state, and local employment discrimination laws in your use of the Employer Platform, including but not limited to Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and state equivalents. TheSHFTApp tools may not be used to filter, screen, or discriminate against candidates on the basis of any protected characteristic.


7. AI Hiring Tools

7.1 Employer Responsibility. AI-powered candidate matching, profile scoring, and recommendation features are assistive tools. All hiring decisions are made exclusively by you. You are solely responsible for ensuring that your use of AI hiring tools complies with applicable employment discrimination laws and any applicable automated employment decision tool regulations (including New York City Local Law 144 and similar emerging regulations).

7.2 No Guarantee of Fit. TheSHFTApp does not guarantee that AI-matched candidates are qualified, available, or suitable for any position.


8. Fees and Payment

Employer Platform access may be subject to fees based on the plan selected, job postings created, candidate contacts made, or other usage metrics. Fees are governed by the Subscription and AI Credits Terms and any applicable order form.


9. Employer Code of Conduct

All Employers must comply with the Employer Code of Conduct, which is incorporated herein.


10. Indemnification

In addition to the indemnification obligations in the Terms of Use, you agree to indemnify TheSHFTApp from claims arising from: (a) your job postings; (b) your hiring practices; (c) your use of candidate data; or (d) your violation of applicable employment law.


11. Termination

TheSHFTApp may suspend or terminate your Employer Account for violation of these Terms, the Terms of Use, the Employer Code of Conduct, or applicable law, with or without prior notice.
