1. Introduction
This Employer Code of Conduct ("Code") establishes the behavioral and ethical standards required of all Employers using the TheSHFTApp Platform. Employers include all organizations, companies, businesses, and their authorized personnel that access the Platform to source, evaluate, or engage Candidates.
Compliance with this Code is a condition of continued access to the Employer Platform. This Code supplements the Employer Platform Terms and Terms of Use.
2. Integrity in Job Postings
2.1 Employers must post only genuine, active job opportunities for which there is a real and current or imminent hiring need.
2.2 Job postings must accurately represent the position title, job type (full-time, part-time, contract, temporary), compensation (where legally required to be disclosed), required qualifications, and location.
2.3 Employers may not post misleading listings that use vague language to attract candidates for purposes other than legitimate employment evaluation (e.g., collecting data, building marketing lists).
2.4 Employers must promptly remove or mark closed any listing for which the hiring process is complete or paused.
3. Candidate Engagement
3.1 Employers must communicate with Candidates professionally, promptly, and in good faith.
3.2 Employers must not leave Candidates without reasonable communication for extended periods during an active hiring process.
3.3 Employers must not misrepresent the status of a hiring process or make commitments they do not intend to honor.
3.4 Employers are encouraged to provide candidates with timely rejection notifications when a decision has been made.
4. Non-Discrimination
4.1 Employers must comply with all applicable federal, state, and local anti-discrimination laws, including Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Equal Pay Act, and state equivalents.
4.2 Employers may not use the Platform to screen, filter, or rank candidates based on protected characteristics, including but not limited to race, color, religion, sex, national origin, age, disability, pregnancy, genetic information, sexual orientation, or gender identity.
4.3 Employers using AI-powered matching or candidate scoring features must independently ensure their hiring practices comply with applicable employment discrimination laws, including laws specific to automated employment decision tools.
5. Candidate Data
5.1 Employers must use candidate data accessed through the Platform only for evaluating candidates for legitimate employment opportunities.
5.2 Employers must not export, share, sell, or repurpose candidate data for any purpose beyond hiring evaluation.
5.3 Employers must store and protect candidate data in compliance with applicable privacy laws and their agreements with TheSHFTApp.
5.4 Employers must honor candidate data rights, including requests for data deletion, as required by applicable law.
6. Workplace Standards
6.1 Employers must maintain lawful, safe, and non-hostile work environments for any candidates hired through the Platform.
6.2 Employers must comply with applicable wage and hour laws, workplace safety requirements, and worker classification regulations for any workers engaged through the Platform.
6.3 Employers are prohibited from charging candidates fees in connection with the hiring process or creating conditions of forced labor, human trafficking, or exploitation.
7. Platform Integrity
7.1 Employers may not use the Platform to contact candidates for purposes unrelated to legitimate employment opportunities.
7.2 Employers may not scrape, harvest, or systematically extract candidate data.
7.3 Employers may not use the Platform to build competitor products or services or to replicate TheSHFTApp's candidate sourcing methods.
8. Enforcement
Violations of this Code may result in warning, suspension, or permanent termination of Employer Platform access. TheSHFTApp may also report violations to relevant authorities where required by law.
