1. Electronic Signatures and Consent
1.1 E-Sign Consent. By creating an Account or checking an acceptance box on the Platform, you consent to conduct business electronically with TheSHFTApp LLC ("TheSHFTApp," "we," "us," or "our"), including entering into legally binding agreements through electronic acceptance. Your electronic acceptance has the same legal effect as a handwritten signature.
1.2 Scope of Consent. Your e-sign consent covers all agreements, terms, policies, notices, and disclosures provided by TheSHFTApp in connection with the Services, including the Terms of Use, Privacy Policy, Subscription Terms, and all incorporated documents.
1.3 Electronic Records. You consent to receive records, agreements, disclosures, notices, and other communications from TheSHFTApp in electronic form, including via email and in-app notifications.
2. Electronic Notices
2.1 Method. TheSHFTApp provides notices by:
- Email to the address associated with your Account;
- In-app notifications within the Platform;
- Prominent posting on the Platform website; or
- Push notifications (with your permission) on mobile devices.
2.2 Your Responsibility. You are responsible for maintaining an accurate, current email address in your Account. Notice sent to your registered email address is effective even if you do not read it.
2.3 Undeliverable Email. If our emails to you bounce or are otherwise undeliverable and we cannot reach you by other means, we may suspend your Account until you update your contact information.
3. Marketing and Promotional Communications
3.1 Consent to Marketing. By creating an Account and not opting out, you consent to receive marketing emails, platform updates, feature announcements, career tips, and promotional communications from TheSHFTApp.
3.2 Opting Out. You may opt out of marketing communications at any time:
- By clicking "Unsubscribe" in any marketing email; or
- By updating your communication preferences in Account settings.
3.3 Transactional Emails. You may not opt out of transactional or service-related emails, including account security alerts, payment receipts, Terms of Use update notices, and legal notices required by law or our agreements.
4. Text/SMS Communications
If you provide a mobile phone number and opt into SMS communications:
- You consent to receive text messages from TheSHFTApp;
- Standard message and data rates from your carrier may apply;
- You may opt out by replying "STOP" to any TheSHFTApp text message; and
- TheSHFTApp is not responsible for charges imposed by your carrier.
5. Push Notifications
Mobile application push notifications are controlled by your device's operating system settings. You may disable push notifications at the device level at any time.
6. Hardware and Software Requirements
To receive electronic records and notices from TheSHFTApp, you need:
- An internet-connected device (computer, tablet, or smartphone);
- A current web browser or mobile operating system supporting the Platform;
- An email account and software capable of receiving email; and
- Sufficient storage for electronic records.
Withdrawal of Consent. You may withdraw e-sign consent by closing your Account and ceasing to use the Services. Withdrawal does not affect the validity of agreements already formed electronically.
