1. Introduction
These Beta Features Terms ("Beta Terms") govern your access to and use of Beta Features made available by TheSHFTApp LLC ("TheSHFTApp," "we," "us," or "our"). Beta Features are features, products, services, integrations, or tools that are in a pre-release, preview, experimental, or early access state.
These Beta Terms supplement the Terms of Use.
2. What Are Beta Features?
Beta Features are designated as "Beta," "Preview," "Experimental," "Early Access," "Pilot," or similar. Beta Features:
- May not be feature-complete or fully tested;
- May contain bugs, errors, or unexpected behavior;
- May have reduced performance, availability, or reliability compared to production features;
- May be changed significantly or discontinued without notice;
- Are not subject to any uptime or service level commitments; and
- May behave differently from their final production version.
3. Access to Beta Features
3.1 Invitation or Opt-In. Beta Features may be available through invitation, waitlist, opt-in toggle in Account settings, or automatic release to designated user groups.
3.2 Eligibility. TheSHFTApp determines eligibility for Beta Feature access in its sole discretion.
3.3 No Entitlement. Participation in a Beta Feature does not entitle you to continued access, a production version of the feature, or any specific outcome or capability.
4. Limitations and Risks
4.1 As-Is and Without Warranty. BETA FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND. THESHFTAPP EXPRESSLY DISCLAIMS ALL WARRANTIES WITH RESPECT TO BETA FEATURES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
4.2 Data Risk. Beta Features may have data stability limitations. We recommend not relying on Beta Features for critical career activities without verifying outputs. Data entered into Beta Features may be subject to deletion, migration, or format changes.
4.3 AI Beta Features. AI-powered Beta Features may produce less accurate, consistent, or reliable outputs than production AI features. The limitations described in the AI Disclosure apply with heightened emphasis to Beta AI features.
5. Feedback on Beta Features
You are encouraged to submit Feedback on Beta Features to support@theshftapp.com. By submitting Feedback, you grant TheSHFTApp the rights described in the Feedback section of the Terms of Use.
6. Confidentiality
If a Beta Feature is designated as confidential, you agree not to publicly disclose, discuss, or describe the Beta Feature or its functionality without TheSHFTApp's prior written permission.
7. Termination of Beta Access
TheSHFTApp may discontinue any Beta Feature or revoke your Beta access at any time, with or without notice, for any reason. Beta Features that transition to production status will be subject to standard Terms of Use and applicable supplemental terms.
8. No Liability for Beta Losses
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESHFTAPP IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR HARM ARISING FROM YOUR USE OF OR RELIANCE ON BETA FEATURES.
